Kullanım Şartları

1. Taraflar ve kabul

Bu şartlar, [Şirket unvanı] tarafından işletilen istanbulvitotransfer.com (“Platform”) ile siteyi ziyaret eden, ilan veren veya ilan üzerinden talep bırakan herkes (“Kullanıcı”) arasında geçerlidir. Siteyi kullanarak bu şartları kabul etmiş sayılırsınız; hesap açarken ayrıca açıkça onaylarsınız.

2. Platformun rolü

Platform, Mercedes Vito sahipleri ile yolcuları buluşturan bir aracıdır. Taşımacılık hizmetini ilan sahibi araç sahibi verir; Platform taşıma sözleşmesinin tarafı değildir, taşıyıcı değildir ve hizmetin ifasını üstlenmez. Sitedeki fiyatlar ilan sahiplerince belirlenir; örnek olarak işaretlenen ilan ve fiyatlar bağlayıcı değildir.

3. Rezervasyon talebi

• İlan sayfasındaki form bir talep iletir; Platform üzerinden ödeme alınmaz ve bağlayıcı bir rezervasyon kurulmaz. Transfer, araç sahibi yolcuyla iletişime geçip koşulları (fiyat, buluşma noktası, ödeme şekli) teyit ettiğinde taraflar arasında kararlaştırılmış olur.
• Talep için üyelik gerekmez. Talep bırakan yolcu; ad, telefon ve e-posta bilgilerinin araç sahibine iletileceğini kabul eder ve doğru bilgi vermekle yükümlüdür.
• İptal, gecikme ve gelmeme (no-show) koşulları yolcu ile araç sahibi arasında belirlenir; Platform bu konuda taraf değildir. Vazgeçen taraf, karşı tarafa mümkün olan en erken zamanda haber vermelidir.
• Araç sahibi, kendisine iletilen yolcu bilgilerini yalnız o transferle ilgili iletişim için kullanır; başka amaçla kullanamaz, üçüncü kişilerle paylaşamaz ve bu verilerin korunmasından kendi adına sorumludur.

4. Üyelik ve hesap

• Hesap açmak ücretsizdir. Hesap, ilan vermek isteyen araç sahipleri içindir.
• Verdiğiniz bilgiler doğru ve güncel olmalıdır. Hesabınızla yapılan işlemlerden siz sorumlusunuz; parolanızı kimseyle paylaşmayın.
• Bir kişi yalnızca kendi adına hesap açabilir; 18 yaşından küçükler hesap açamaz.
• Hesabınızla ilgili işlemsel e-postalar (doğrulama, parola sıfırlama, ilan onayı/reddi, gelen talep bildirimi) gönderilir; bunlar hizmetin parçasıdır. Pazarlama e-postası gönderilmez.
• Hesabınızı hesap ayarlarından istediğiniz zaman silebilirsiniz; ilanlarınız, fotoğraflarınız ve gelen talepler silinir.

5. İlan kuralları

• İlan yalnızca ilan sahibinin kullanımında olan gerçek bir araç için verilebilir; fotoğraflar aracın kendisine ait olmalıdır.
• Model, yıl, kapasite, donanım ve fiyat bilgileri doğru olmalı; değişiklikler ilana yansıtılmalıdır.
• İlanınız yayına alındığında adınızın kısaltılmış hâli, telefon numaranız, konumunuz, konuştuğunuz diller, araç bilgileri, fiyatlar ve fotoğraflar herkese açık olarak yayınlanır ve arama motorlarında görünebilir. İlan vermekle bunu kabul edersiniz; ilanı duraklattığınızda veya sildiğinizde bilgiler herkese açık olmaktan çıkar.
• Yayındaki bir ilanda fiyat değişiklikleri hemen yayına girer; fiyat dışındaki değişiklikler (araç bilgileri, konum, diller) onaya gönderilir ve onaylanana kadar ilan önceki hâliyle yayında kalır.
• Araç, sürücü ve taşımacılık faaliyeti için gerekli belge, sigorta, izin ve vergisel yükümlülüklerden ilan sahibi sorumludur. Platform bu belgeleri doğrulama taahhüdü vermez.
• İlanlar yayına alınmadan önce kısa bir kontrolden geçer; Platform gerekçe göstererek ya da göstermeksizin ilanı yayınlamama veya yayından kaldırma hakkını saklı tutar.

6. Yasak kullanımlar

• Yanıltıcı, eksik veya başkasına ait bilgi ve görsellerle ilan vermek.
• Siteyi istenmeyen ileti (spam), dolandırıcılık veya hukuka aykırı bir amaçla kullanmak.
• Siteye otomatik araçlarla veri toplama (scraping), zararlı yazılım veya aşırı yük yönlendirmek.
• Diğer kullanıcıların iletişim bilgilerini ilan ve talep amacı dışında kullanmak.

7. Ücret ve ödeme

Platform şu an ücret veya komisyon almaz; ödeme, yolcu ile araç sahibi arasında doğrudan yapılır. İleride bir ücretlendirme başlatılırsa bu sayfada ve üyelere e-posta ile önceden duyurulur.

8. Sorumluluk sınırı

Platform “olduğu gibi” sunulur; kesintisiz veya hatasız çalışacağı garanti edilmez. Transferin gerçekleşmesi, gecikme, iptal, hasar veya taraflar arasındaki diğer uyuşmazlıklardan ilgili araç sahibi ve yolcu sorumludur. Emredici hukuk kurallarından doğan sorumluluk saklıdır.

9. Askıya alma ve kaldırma

Bu şartlara aykırı ilanlar yayından kaldırılabilir, hesaplar uyarı yapılmaksızın askıya alınabilir veya kapatılabilir. Hesabınız askıya alınırsa giriş yapamazsınız ve ilanlarınız askı süresince yolculara görünmez; askıya alma gerekçesi hesabınızın e-posta adresine bildirilir.

10. Fikri haklar

Sitenin tasarımı, metinleri ve yazılımı Platforma aittir. İlan içerikleri ilan sahibine aittir; ilan sahibi bu içeriğin sitede ve arama motorlarında yayınlanması için Platforma ücretsiz kullanım izni verir.

11. Kişisel veriler

Kişisel verilerin işlenmesi Gizlilik Politikası ve KVKK Aydınlatma Metni’nde açıklanır; bu metinler şartların ayrılmaz parçasıdır.

12. Değişiklikler

Şartlar gerektiğinde güncellenir; geçerli sürüm ve tarihi bu sayfada yer alır. Önemli değişiklikler üyelere e-posta ile bildirilir; değişiklikten sonra siteyi kullanmaya devam etmek güncel şartları kabul anlamına gelir.

13. Uygulanacak hukuk ve iletişim

Bu şartlara Türkiye Cumhuriyeti hukuku uygulanır; uyuşmazlıklarda İstanbul mahkemeleri ve icra daireleri yetkilidir. Tüketicilerin yasal hakları ve tüketici hakem heyetlerine başvuru hakkı saklıdır. Sorularınız için: [email protected]

1. Parties and acceptance

These terms apply between istanbulvitotransfer.com (the “Platform”), operated by [Şirket unvanı], and everyone who visits the site, publishes a listing or submits a request through a listing (the “User”). By using the site you are deemed to have accepted these terms; you also confirm them explicitly when you create an account.

2. The role of the Platform

The Platform is an intermediary that brings Mercedes Vito owners and passengers together. The transport service is provided by the vehicle owner who publishes the listing; the Platform is not a party to the contract of carriage, is not a carrier and does not undertake performance of the service. Prices on the site are set by the listing owners; listings and prices marked as samples are not binding.

3. Booking request

• The form on a listing page submits a request; no payment is taken through the Platform and no binding reservation is created. The transfer is agreed between the parties once the vehicle owner contacts the passenger and confirms the conditions (price, meeting point, method of payment).
• No membership is required for a request. A passenger who submits a request accepts that their name, phone and email will be passed to the vehicle owner and is obliged to provide accurate information.
• Cancellation, delay and no-show conditions are agreed between the passenger and the vehicle owner; the Platform is not a party to them. The party who withdraws must inform the other party as early as possible.
• The vehicle owner uses the passenger information passed to them only to communicate about that transfer; they may not use it for any other purpose, may not share it with third parties and are responsible on their own behalf for the protection of these data.

4. Membership and account

• Creating an account is free. Accounts are for vehicle owners who wish to publish listings.
• The information you provide must be accurate and up to date. You are responsible for the actions taken with your account; do not share your password with anyone.
• A person may open an account only in their own name; persons under 18 may not open an account.
• Transactional emails about your account (verification, password reset, listing approval/rejection, incoming request notification) are sent; these are part of the service. No marketing email is sent.
• You can delete your account at any time from the account settings; your listings, photos and incoming requests are deleted.

5. Listing rules

• A listing may be published only for a real vehicle that is at the listing owner’s disposal; the photos must be of that vehicle.
• Model, year, capacity, trim and price information must be accurate; changes must be reflected in the listing.
• When your listing is published, the short form of your name, your phone number, your location, the languages you speak, vehicle details, prices and photos are published publicly and may appear in search engines. By publishing a listing you accept this; when you pause or delete the listing, the information is no longer public.
• For a live listing, price changes take effect immediately; changes other than prices (vehicle details, location, languages) are sent for review and the listing stays live in its previous version until they are approved.
• The listing owner is responsible for the documents, insurance, permits and tax obligations required for the vehicle, the driver and the transport activity. The Platform gives no undertaking to verify these documents.
• Listings pass a short review before they are published; the Platform reserves the right to refuse to publish or to remove a listing, with or without stating a reason.

6. Prohibited uses

• Publishing listings with misleading, incomplete information or with information and images belonging to someone else.
• Using the site for unsolicited messages (spam), fraud or any unlawful purpose.
• Directing automated data collection (scraping), malicious software or excessive load at the site.
• Using other users’ contact details for any purpose other than the listing and the request.

7. Fees and payment

The Platform currently charges no fee or commission; payment is made directly between the passenger and the vehicle owner. If charging is introduced in the future, it will be announced in advance on this page and by email to members.

8. Limitation of liability

The Platform is provided “as is”; it is not guaranteed to operate uninterrupted or error-free. The vehicle owner and the passenger concerned are responsible for the performance of the transfer, delays, cancellations, damage and other disputes between the parties. Liability arising from mandatory provisions of law is reserved.

9. Suspension and removal

Listings that breach these terms may be removed, and accounts may be suspended or closed without warning. If your account is suspended you cannot sign in and your listings are not visible to passengers for the duration of the suspension; the reason for the suspension is notified to your account email address.

10. Intellectual property

The design, texts and software of the site belong to the Platform. Listing content belongs to the listing owner; the listing owner grants the Platform a free licence to publish that content on the site and in search engines.

11. Personal data

The processing of personal data is explained in the Privacy Policy and the KVKK Notice; these texts form an integral part of the terms.

12. Changes

The terms are updated when necessary; the current version and its date appear on this page. Significant changes are notified to members by email; continuing to use the site after a change means accepting the current terms.

13. Governing law and contact

These terms are governed by the law of the Republic of Türkiye; the courts and enforcement offices of İstanbul have jurisdiction over disputes. Consumers’ statutory rights and their right to apply to consumer arbitration committees are reserved. For questions: [email protected]
